Public Hearing – Nieves Variance Request

PUBLIC NOTICE 

Notice of public hearings is hereby given pursuant to the provisions of the Pennsylvania Municipalities Planning Code (Act 247 and 170 as amended) and the Greene Township Code (as amended). The purpose of said public hearings is for the Greene Township Zoning Hearing Board to hear the following: Request #1, submitted by Jenna Nieves, 965 Coldspring Road, Fayetteville, PA 17222. Property is located in the R-2 (Medium Density Residential) Zoning District and would be classed as an Existing small lot per Greene Township Code 105-27.D. Applicant is requesting a variance of the 5’ minimum required side yard setback distance in the approximate amount of 4 feet for construction of a 30’ x 32’detached garage located along the left side property line. The existing 21’ x 23’ garage in this same location is 1’ from the left side property line. It will be demolished and the new construction is proposed to be located the same distance from the property line but will extend an additional 9 feet in depth. Applicant also requests a variance of the requirement limiting expansion of a nonconforming structure to 30% of the recognized nonconformance. Requests are in reference to Greene Township Code 105-25.A(2) and 105-46.D(1). Request #2, submitted by William Rosenberry, Sr., 3858 Creekside Drive, Chambersburg, PA 17202. Property is located in the R-1 (Low Density Residential) Zoning District and would be classed as an Existing small lot per Greene Township Code 105-27.D. Applicant is requesting a variance of the minimum 30 foot required front yard setback distance in the approximate amount of 8 feet for construction of an 8’ x 12’ front porch onto his dwelling. Request is in reference to Greene Township Code 105-17.A. The public hearings on these requests will begin at 5:30 p.m. on Tuesday, September 17, 2024 in the Greene Township Building Meeting Room, 1145 Garver Lane, Chambersburg, PA 17202.
